1. Eligibility and acceptance
You must be at least 18 years old and capable of forming a binding contract to use FishMem. If you use the services for a company or other organization, you represent that you have authority to bind that entity to these terms. By accessing or using FishMem, you confirm that you have read and agree to these terms and our Privacy Policy.
2. Accounts and registration
Some features require an account. You must provide accurate, current, and complete information, keep credentials secure, protect API keys, and promptly notify us if you believe your account or keys have been accessed without authorization. You are responsible for activity that occurs through your account.
3. Privacy and service communications
We process personal information as described in our Privacy Policy. By using FishMem, you acknowledge that we may collect and use account, usage, device, and billing information to operate, secure, support, and improve the service. We may send transactional messages about your account, billing, service updates, legal notices, and support requests.
4. Service scope and availability
FishMem provides hosted memory APIs, dashboard tooling, API keys, workspace features, billing, and related workflows. We may change, add, suspend, or discontinue features at any time. We try to describe the service accurately, but previews, examples, pricing displays, provider behavior, and availability may change or contain errors.
5. Payments, credits, and refunds
Some services require payment. Paid plans are monthly subscriptions handled through third-party payment processors. Credits are consumed by metered memory API operations, including adds and searches. Unless required by law or stated otherwise at checkout, refund requests may be reviewed for the current billing period if the paid usage tied to that period has not been used.
6. License and intellectual property
Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use FishMem for internal, personal, or business use. The service, software, interface, branding, documentation, and underlying technology are owned by us or our licensors. You may not copy, resell, reverse engineer, remove proprietary notices, scrape the service, or use the service to build competing AI memory products unless we explicitly allow it in writing.
7. Inputs and memory data
You retain the rights you already have in content you submit to FishMem. Subject to applicable law and third-party provider restrictions, you are responsible for reviewing what your application stores and retrieves. You grant us a limited license to host, store, process, transmit, and display inputs, extracted memories, metadata, and related outputs as needed to provide, secure, maintain, support, improve, and enforce the service.
8. Sensitive materials
You are responsible for ensuring that your application has appropriate rights, notices, consents, and legal basis for any personal or sensitive data sent to the memory API. Do not send prohibited or regulated data unless your plan and written agreement explicitly allow it.
9. Prohibited content and use
You may not use FishMem to create, upload, store, retrieve, distribute, or enable illegal, harmful, exploitative, infringing, deceptive, non-consensual, sexual, harassing, hateful, violent, fraudulent, political-manipulation, malware, or misinformation content. You may not bypass rate limits, defeat security controls, exploit bugs or credit logic, use another user's credentials, or disrupt the service or other users.
10. Third-party services
FishMem relies on third-party model providers, identity providers, hosting providers, analytics services, and payment processors. Your use of those integrations may be subject to separate third-party terms, policies, technical limits, output restrictions, and availability. We are not responsible for third-party services that we do not control.
11. Enforcement and termination
We may investigate violations and take appropriate action, including removing content, refusing transactions, limiting features, suspending access, or terminating accounts. We may act immediately where we detect abnormal, abusive, unlawful, or risky behavior. If your account is suspended or terminated for cause, you remain responsible for fees already incurred and obligations that accrued before termination.
12. Disclaimers and liability
FishMem is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising from use of the service.
13. Indemnification
You agree to defend, indemnify, and hold harmless FishMem, its operators, affiliates, personnel, contractors, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising out of your inputs, memory data, outputs, content, violation of these terms, misuse of personal data, or infringement of third-party rights.
14. Force majeure and severability
Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including natural disasters, war, civil unrest, labor disputes, internet outages, infrastructure failures, provider outages, or government actions. If any provision is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.
15. Changes to these terms
We may update these terms from time to time. When we do, we will post the revised version on this page and update the effective date. Your continued use of FishMem after updated terms take effect constitutes acceptance of the revised terms.
